1. Orders and Sales
Order Confirmation: A contract of sale is formed only when Le Petit Paws issues an order confirmation via email to the customer.
Pricing and Errors: In the event of a clear typographical or technical error in pricing, Le Petit Paws reserves the right to cancel the order. In such instances, we will offer the customer a 15% discount coupon as a gesture of goodwill. If a customer is overcharged for a product, we will issue a refund for the excess amount.
Sales Tax and Duties: Prices listed on our website do not include import taxes, duties, or customs fees applicable in the destination country. For international orders, the purchaser is responsible for compliance with local import laws and the payment of any taxes or fees imposed by customs authorities. Le Petit Paws does not collect sales tax outside of Texas. Within the state of Texas, sales tax will be applied at the statutory rate of 8.25%.
2. Logistics and Shipping
Delivery Responsibility: Risk of loss and title for items pass to the customer upon our delivery of the package to the carrier. We include a protection clause for lost packages. If a package is marked as "delivered" by the carrier, the customer has 48 hours to report an issue. Failure to report within this window will be deemed as successfully delivered.
Shipping Estimates: Shipping timeframes are estimates and depend on the product type:
Collection Products: 7–10 business days (Domestic); 10–15 business days (International).
Customized Products: 10–20 business days (Domestic); 15–30 business days (International).
3. Intellectual Property
Site Content: All content on this website, including but not limited to photography (e.g., Cephy), clothing designs, logos, and written material, is the exclusive property of Le Petit Paws. Unauthorized use, reproduction, or distribution is strictly prohibited.
4. Limitation of Liability and Product Usage
Supervision: All Le Petit Paws products are intended for use under the direct and constant supervision of a responsible adult. The customer assumes full responsibility for ensuring the product is suitable for their pet and used safely.
Disclaimer: Le Petit Paws disclaims all liability for damages, injuries, or incidents resulting from improper use, negligence, or lack of supervision by the owner or end-user. By completing a purchase, the customer releases Le Petit Paws from any claims related to the use of our products.
5. Governing Law and Jurisdiction
Governing Law: These Terms and Conditions shall be governed by the laws of the State of Texas, without regard to its conflict of law principles.
Dispute Resolution and Mandatory Arbitration: Any dispute arising from these Terms or the use of Le Petit Paws products shall be resolved through binding arbitration governed by U.S. law. Parties waive the right to participate in class-action lawsuits or jury trials.
Jurisdiction: Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Travis County, Texas.
6. Custom Designs
Copyright: All custom designs, illustrations, and patterns created by Le Petit Paws remain the exclusive intellectual property of Le Petit Paws.
Commercial Rights: Payment for custom designs covers the creation service and the physical product; it does not constitute a transfer of copyright. Le Petit Paws reserves the right to reproduce, display, sell, or use any custom design in future collections, marketing, or commercial purposes without obligation to the customer.
